What is positive and nagative fundamental rights ?


Fundamental Rights

Constitution of india provided fundamental rights to it's citizens for their all round development(material,intellectual,moral and spiritual).They are described in article 12 to 35 of the constitution and most of them are against arbitrary action of state.some rights are nagative in nature while some rights are positive in nature,which are described below.

Fundamental Right

Nagative Rights:–


There are some fundamental rights which put limitation or restriction to the state, the occurrence of which would have curbed the freedom that an individual/community enjoys. These are


  1. Equality before law(art:14)
  2. ​Right to freedom(art:19)​
  3. protection of life and personal liberty(art:21)
  4. ​prohibition of discrimination on Certain grounds(art:15)
  5. ​Eqality of opportunity(art:16)


Positive Rights:–



Positive rights are direct action by the state which improve the ability of the individual/community to live the life they desire.


  1. Equal protection of law(art:14)
  2. ​Abolition of untouchability(art:17)
  3. ​Rights to education(art:21A)
  4. ​Rights agaist exploitation(art:23-24)
  5. ​Freedom of religion(art:25-28)
  6. ​cultural and educational rights(art:29-30).

Fundamental Right

                      Hence  both positive and nagative fundamental rights play a significant role in democracy because they are most essential for the attainment of full intellectual, moral, and spiritual status of an individual.
